Carrying a Fake ID in California

What is a Fake ID?

Before determining the consequences of being caught carrying a fake ID, it’s important to understand what a fake ID is. A fake ID is any form of government issued identification that has been changed or fabricated. This can include driver’s licenses, passports, social security cards, and any other type of ID. You can be convicted for carrying an ID where the name, birthdate, picture, or any other information on the ID has been changed. 

When is it a Crime?

In California, you technically cannot be charged simply for having a fake ID. You are charged only if there is proof that there was intent to deceive. For example, if someone under the age of 21 were to change the birthdate on their ID in order to get into a bar then this would count as intent to deceive. Once this intent to deceive is proven, there are a few other criteria that need to be met. In order for you to be considered “carrying” a fake ID, it needs to be found on your person or in a location under your control. This includes your home or your car. 

What Are the Consequences?

If you have been charged with carrying a fake ID, with the intent to deceive, the consequences will vary depending on your situation. You can be charged with a misdemeanor or a felony for carrying a fake ID. If you are charged with a misdemeanor, then you could potentially face up to a year in jail. You also could be required to perform community service and/or pay up to $1000 in fines. A felony will land you with more severe consequences. You could spend up to three years in jail in addition to probation, community service and fines up to $10,000.
